Hereinafter referred to as “Bel Fries”, “we”, or “us”.

2. Applicability

  • 2.1 These Terms and Conditions apply to every offer made by Bel Fries and to every distance agreement concluded between Bel Fries and the customer via the website or other digital ordering channels.

  • 2.2 By placing an order, the customer explicitly agrees to these Terms and Conditions.

  • 2.3 Deviations from these Terms are only valid if confirmed in writing by Bel Fries.


3. Offer and Information

  • 3.1 All products, prices, and information displayed on the website are prepared with the greatest possible care.

  • 3.2 Obvious errors or mistakes in the offer (including pricing or typographical errors) are not binding for Bel Fries.

  • 3.3 Bel Fries reserves the right to modify the offer or remove products from sale at any time.


4. Formation of the Agreement

  • 4.1 The agreement is concluded once the customer places an order via the website and receives an order confirmation by email or through the ordering system.

  • 4.2 Bel Fries reserves the right to refuse any order in case of force majeure, incorrect data, or suspected fraud.


5. Prices and Payment

  • 5.1 All prices are stated in euros and include VAT, unless otherwise specified.

  • 5.2 Any delivery or service fees will be clearly indicated before completing the order.

  • 5.3 Payment must be made using the payment methods provided on the website and must be completed in full before delivery or pickup, unless otherwise agreed.


6. Delivery and Pickup

  • 6.1 Delivery and pickup times are indicative and may vary due to busy periods, traffic, or external circumstances.

  • 6.2 Delays do not entitle the customer to compensation, unless caused by intent or gross negligence.

  • 6.3 If the customer is not present at the agreed delivery or pickup time, Bel Fries may consider the order fulfilled without refund.


7. Right of Withdrawal

  • 7.1 In accordance with Article VI.53 of the Belgian Economic Law Code, the right of withdrawal does not apply to perishable goods or freshly prepared food.

  • 7.2 All products offered by Bel Fries that are freshly prepared or perishable are final upon ordering and cannot be cancelled or returned.

 
8. Complaints

  • 8.1 Complaints must be submitted within 24 hours of receiving the order via the provided email address.

  • 8.2 After this period, the order is considered accepted.

  • 8.3 Bel Fries will handle all complaints within a reasonable timeframe and seek an appropriate solution.


9. Liability

  • 9.1 Bel Fries is not liable for indirect damages, consequential damages, or loss of profit.

  • 9.2 Liability is in all cases limited to the value of the relevant order.

  • 9.3 Bel Fries is not responsible for damages caused by incorrect information provided by the customer (such as delivery address errors).


10. Force Majeure

  • 10.1 Bel Fries is not obliged to fulfil any obligations in case of force majeure.

  • 10.2 Force majeure includes, but is not limited to: power outages, strikes, illness, fire, technical failures, government measures, traffic disruptions, and supplier issues.

  • 10.3 In such cases, orders may be delayed or cancelled without compensation.


11. Intellectual Property

  • 11.1 All website content (texts, logos, images, design) is the property of Bel Fries or its licensors.

  • 11.2 It is not permitted to copy, distribute, or use any materials without prior written consent.


12. Privacy

  • 12.1 Bel Fries processes personal data in accordance with applicable GDPR regulations.

  • 12.2 Personal data is used solely for order processing, customer service, and legal obligations.

13. Governing Law and Jurisdiction

  • 13.1 These Terms and Conditions are governed by Belgian law.

  • 13.2 Any disputes shall be subject exclusively to the competent courts of the district where Bel Fries is established, unless mandatory law provides otherwise.


14. Amendments

  • 14.1 Bel Fries reserves the right to modify these Terms and Conditions at any time.

  • 14.2 The most recent version will always be available on the website and applies from the moment of publication.
